Divorce Modification Attorney in Oakland County
More Than Four Decades of Family Law Guidance
A post-judgment modification asks the court to change an existing family court order when the circumstances underlying it no longer fit. Lady4Justice, PLLC represents Oakland County families in matters involving child custody and parenting time, drawing on more than four decades of combined family law experience.
We take a holistic, personalized approach to each request. We begin by understanding the existing order, what has changed since it was entered, and what arrangement you believe is now appropriate for your family.

How We Approach Post-Judgment Modifications
A modification matter begins with the language of the existing court order and the facts that have developed since the court entered it. During an initial consultation, we can review the order, discuss the proposed revision, and identify the applicable legal standard.
A motion is a formal request asking the court to modify an existing order. When the parties disagree, the court evaluates the governing legal standard and each side’s evidence rather than simply choosing the arrangement it prefers.
A modification strategy may include:
- Reviewing the existing judgment or order and the terms affected by the proposed revision.
- Assessing the timing, significance, and available documentation of changed circumstances.
- Exploring collaborative processes, cooperative divorce, mediation, or another appropriate form of alternative dispute resolution.
- Preparing for litigation when the parties can’t reach an amicable agreement.
Our solution-oriented approach leaves room for negotiated terms while recognizing that some disputes require court advocacy. Any agreement affecting an existing order generally must be submitted to the court before it becomes enforceable.
Michigan Standards for Custody & Schedule Changes
Michigan law applies different standards to custody and parenting-time changes. The distinction matters because a revised schedule may leave the child’s established custodial environment intact. This environment is the relationship in which the child looks to a parent for guidance, discipline, necessities, and comfort.
Changing a Custody Order
Under MCL 722.27(1)(c), a court may modify a prior custody judgment or order when the requesting party shows proper cause or a change of circumstances. In Vodvarka v Grasmeyer, proper cause is described as an appropriate ground connected to at least one statutory best-interest factor and significant enough to affect the child’s well-being.
A change of circumstances under Vodvarka requires a material change since the last custody order that has affected, or could significantly affect, the child’s well-being. The court must address this threshold before reconsidering the statutory best-interest factors. If the proposed change would alter an established custodial environment, clear and convincing evidence must show that it serves the child’s best interests.
Revising a Parenting Schedule
Requests to revise a schedule can involve a different threshold analysis. In Shade v Wright, the Michigan Court of Appeals recognized that ordinary life changes insufficient to reopen custody may still justify reconsidering parenting time.
The precise analysis depends partly on whether the proposed adjustment would change the established custodial environment. A divorce modification lawyer serving Oakland County can evaluate the requested terms rather than assuming every schedule dispute follows the custody standard.
Michigan Child-Support Modification Rules
Either parent may request a Friend of the Court review every 36 months under MCL 552.517b, even without alleging changed circumstances. The Friend of the Court assists the court with support recommendations and enforcement. A parent may also file a Motion Regarding Support after a substantial change in circumstances.
Michigan’s review rules generally require the calculated support amount to differ from the existing order by at least 10% or $50 per month, whichever is greater, before the Friend of the Court petitions for a modification. The calculation and applicable procedure depend on the facts and the governing Michigan Child Support Formula.
Timing is especially important. Under MCL 552.603(2), child support generally can be modified retroactively only from the date the other parent receives notice of the petition. A court generally can’t reduce or increase support for periods before the request was filed and served.
Discuss a Family Court Modification
A consultation is an opportunity to review the order and explain the circumstances prompting your request. We offer flexible payment plans to clients in need to ease the financial concerns that can accompany another court proceeding.
